There is a proposed Settlement of a class action in the
United States District Court for the District of New Jersey titled
Skeen v. BMW of North America, LLC,
Civil Number 2:13-cv-01531-WHW-CLW.

The Court granted Final Approval on July 14, 2016 and the Settlement became final and effective September 8, 2016. Benefits are anticipated to be mailed sometime in the Winter 2016 to class members who
submitted an approved claim form.
The lawsuit claimed that BMW made and sold certain MINI Coopers knowing that the cars had defective timing chain components,
which are parts inside the engine. Defendants deny they did anything wrong and stand behind and support their products.
The Court did not decide in favor of Plaintiffs or Defendants. Instead, both sides agreed to a settlement. That way, they
avoid the cost and risk of a trial, so that the people affected will get benefits. The Class Representatives and the attorneys
think the settlement is best for everyone.
Class Member Definition
All current and former owners and lessees within the United States, the District of Columbia, and Puerto Rico of the following vehicles, manufactured at any time from start of production in November 2006 through July 2010 (“Class Vehicle”):
- 2008 through 2009 model year MINI Cooper S Clubman (R55)
- 2007 through 2009 model year MINI Cooper S Hardtop (R56)
- 2009 through 2010 model year MINI Cooper S Convertible (R57)
Class Member Options
Submit a Claim Form postmarked on or before July 1, 2016
To receive a reimbursement benefit, Class Members must submit a Claim Form postmarked on or before July 1, 2016
(July 21, 2016 for class members from KS, NH, OK, PA; or August 29, 2016 for class members from HI).
The Claim Form must be completed in its entirety and should be
signed under penalty of perjury. You must also include all
Required Documentation. A Claim Form can be found on the
Key Dates/Docs page.
Exclude Yourself from the Settlement before July 1, 2016
If you wish to exclude yourself from the Settlement, you must follow the instructions for how to
exclude yourself from the Notice on the Key Dates/Docs page. (This deadline has passed)
Object to the Settlement before July 1, 2016
If you wish to object to the Settlement, you must submit your objections on or before July 1, 2016.
Please follow the instructions for how to object from the Notice, which can be found on the Key Dates/Docs page. (This deadline has passed)
Attend the Fairness Hearing on July 14, 2016
If you wish to be heard at the Fairness Hearing for any reason,
then you must also notify the Clerk of the Court, Class Counsel, and Defense Counsel, in writing, on or before
July 1, 2016, of your intention to appear.
Please refer to page 7 of the Notice which can be found on the Key Dates/Docs page. (The Fairness Hearing has already occurred)
If you do nothing, you’ll get no money from this settlement although you will still receive a warranty extension.
But, unless you exclude yourself, you won’t be able to start a lawsuit, continue with a lawsuit, or be part of any
other lawsuit against BMW about the legal issues in this case, ever again.
